By signing up to the Next Presence Affiliate Program you are agreeing to this affiliate agreement and terms of service. Next Presence may, at any time change these terms without written notice. "We", "Us" and "Our" refers to Next Presence.

General

1. We reserve the right to refuse affiliate/partner status to any individual for any reason.
    
2. You agree to provide accurate and up to date information regarding your account.
    
3. We have the right to suspend or cancel your account for breaching these terms of service or any reason that is deemed necessary by the staff of Next Presence.
   
4. You agree and understand that you are an independent contractor and not an employee.
     
5. NO AFFILIATE SHALL SIGN UP FOR MORE THAN ONE AFFILIATE ACCOUNT.

Commissions

1. You must be in "active" status with at least 2 active personal sales to earn commission payments on personal sales or from manager commissions.
    
2. If your active sales falls below 2 accounts your account is place in an un-active temporary hold mode until the number of active sales reach 2 or above, you DO NOT earn commissions in this status.
    
3. You forfeit any commissions on your first account sold or if your status falls to an in-active mode for any reason.
     
4. Commissions for personal sales are 25%, two tier manager commissions are 5% of your referred affiliates sales. Commissions are paid on a residual basis, as long as the referred account is paid up to date and active.
     
5. You do not earn commissions on free trial accounts that do not sign up for permanent service.
     
6. IF AN ACCOUNT FAILS TO PAY FEES DUE in any given monthly billing cycle and continues to not pay by the 15th day commission payment date, you forfeit commissions on that account for that given billing period even if the suspended account returns and pays after the 15th however the account status will revert back to active and commissions will resume the next monthly commission cycle.

Payments

1. We post commissions to affiliate accounts on the 15th of each month, if in any month your balance reaches the minimum payout amount of $50 or an amount specified by you, we will send your commission payment to you via the PayPal email address specified on your account.
    
2. We reserve the right to suspend a payment in the event of the suspicion of fraud and will only release payment once fraud is ruled out.
     
3. You agree to provide correct US or Foreign tax identification in order to receive commission payments.

Referrals

1. You agree to not represent Next Presence or any of our sites in a manner that is false.
     
2. You agree to not represent yourself as an official representative of Next Presence to any referrals and agree to represent yourself as an "Account Executive" or "Affiliate" at all times.
    
3. You MAY sign up for an account and refer yourself at any time.
    
4. YOU MAY earn commissions on your own account only if you have sold at least 2 accounts or more, you may not earn commissions on your own account referred to yourself if that is the only account that has been sold.

Private Label Affiliate Site

1. You agree to represent the services offered in a true and appropriate manner on your Private Label Affiliate Site and not mis-represent the services offered in any way.
     
2. You agree that you will make any changes to your Private Label Site (that relates to our services specifically) that is deemed necessary by the Next Presence staff and management and agree that Next Presence may suspend your account for failure to do so.
     
3. You agree that you will not use Unsolicited Commercial Email (SPAM) to promote your Private Label Site.
    
4. You may not use any copyrighted materials that belong to a 3rd party on your Private Label Site without permission from those copyright holders.
     
5. Although we do not dictate what other services you offer on your private label site, we reserve the right to refuse the Private Label Site to be displayed along with, or on the same URL with the following services or products.
    
   - Adult related products or services as well as pornography and porn related content
   - Illegal content or activity
   - Spam, scam, hacking related content or materials.
   - Hate content or hate glorification.

Misc.

1. You agree to not attempt to fraudulently obtain commissions in any manner.
     
2. You will not market these services or our websites using Unsolicited Commercial Email (SPAM).
    
3. Affiliate MAY ONLY advertise their special affiliate/partner link or Private Label Site and understands that they will not get any credit or there will be no affiliate tracking if the affiliate links are not proper. Affiliate understands that it is your sole obligation to make sure your linking or referring to our site is correct in order to receive credit.
     
4. You may create banners or advertisements that promote Next Presence or any of our websites however we require that you first obtain approval for your banners before you start an advertising campaign. You also agree that any banners that are created by you and are approved become the sole property of Next Presence.
